Immigration Fees

Below are the immigration related fees for case preparation and filing that must be paid by the hiring or employing unit at KU. For tenured, tenure-track, and teaching professor positions in CLAS, the College Dean’s office will cover all of the required immigration fees for those positions. In nearly all circumstances these fees must be paid by the employer and the costs cannot be passed on to the employee in any way (i.e. reduction in start-up funds, deduction in salary, etc.). All required USCIS fees will be paid directly to USCIS by HR along with the case filing. HR will then bill the hiring/employing unit for all required fees via a DARBI billing invoice. If a case is referred to KU’S designated outside immigration counsel for preparation, the employing/hiring unit is responsible for all of the attorney fees as well as the USCIS fees.

All H-1B fees must be paid by KU and cannot be passed on to the international employee in any way.

*Premium Processing is an expedited service that is available from USCIS for H-1B petitions.  Within 15 business days of filing the petition, USCIS will approve, deny, or request additional evidence.  Premium processing service may be requested at the time H-1B petition is submitted or at a later date, if necessary. Given the regular processing times of USCIS, premium processing is used in most new H-1B cases.

Employee Costs

The costs mentioned above do not include additional fees that an international employee will incur that KU typically does not cover, including their own visa application fee at the U.S. Consulate abroad ($160); costs associated with their family members obtaining a necessary dependent status ($470 if in the U.S. or the $205 visa application fee per person if outside the US.).  Additionally, KU typically does not cover the filing fee for the final step of the permanent residency process (Form I-485) the filing of which is typically $1,440 per adult ($950 per child) or any associated immigration attorney fees.
